From a legal standpoint, copyright protection starts as soon as your song is 'fixed'—meaning it's written down, recorded, or otherwise stored in a tangible form you can hear, read, or reproduce. The moment you create an original work, it is automatically copyrighted whether you register it or not. However, to gain the legal benefits of a copyright, you need to register your song.
It's vital for songwriters to understand that a copyright isn't necessarily conclusive proof that a song is yours—even if you registered and received your copyright. Unfortunately, having a copyright alone might not be enough to prove authorship of a song. Someone can take you to court and challenge your claim, or you may find someone trying to claim authorship of your song, and you might have to sue them. I've personally experienced this more than once, and in an upcoming article, I'll share some of the horror stories from other songwriters and myself.
Bottom line: If your authorship is ever challenged, you'll need more than just your word. And if you used AI as a co-writer, you'll definitely need documentation to show your human contribution in order to obtain a copyright.
